David Herbert Vickers fonds

The fonds consists of the Judge's copies of exhibits, records, and trial transcripts documenting the trial Tsilhqot'in Nation v. British Columbia in the Supreme Court of British Columbia. The fonds is comprised of textual records, maps, discs, and floppy disks.

David Herbert Vickers was the trial judge for Tsilhqot'in Nation v. British Columbia (2007 BCSC 1700) in the Supreme Court of British Columbia. The case later went to the British Columbia Court of Appeal (2012 BCCA 285), and then to the Supreme Court of Canada (2014 SCC 44). Justice Vickers was called to the bar in 1960, and became a Justice of the BC Supreme Court in 1992.

The transcript series includes cerlox bound transcripts of each day of the trial, some transcripts include digital copies of the text on floppy disks. The Records and Authorities Series includes previous judgments related to the trial, copies of various trial records and the books of authorities of the Plaintiff and Defendants. Some records include a digital copy of the text on a floppy disk.

The exhibit series includes copies all of the exhibits and other evidence provided to Justice Vickers. Textual records include correspondence, research reports, historical records, legal documents, affidavits, published materials, expert testimonies and associated background material. Non-textual material include maps, copies of map overlays, copies of drawings, and photographs. Some maps and exhibits have paper and digital copies on CDs or DVDs. Justice Vickers did not receive any of the objects, video depositions or cassette tapes entered as exhibits.

The exhibits series includes an order dated 8 September 2003 regarding the appointment of a court cartographer, Kathleen Lush, who was responsible for digitizing all maps and map overlays entered as exhibits. The authorities series includes a letter dated 17 May 2007 from Erin Christie to the Trial Coordinator describing the process of creating and using the digital copies of the exhibits in a summation database on six CDs.
